Please read these documents carefully. By using Apeos Device Info or any Cyber AI Connect service, you agree to be bound by both the Terms of Service and Privacy Policy.
In these Terms, the following definitions apply:

| Software | The Apeos Device Info application and all related modules, updates, patches, and documentation supplied by Cyber AI Connect. |
| Licence | The non-exclusive, non-transferable, limited right to use the Software granted under clause 3. |
| Device | A single Fujifilm Apeos multifunction device on which the Software is installed and authorised to run. |
| Site Licence | A licence authorising installation of the Software on up to ten (10) Devices at a single physical location. |
| Paid Term | The twelve (12) month period from the date of purchase for which Fees are paid. |
| Complimentary Extension | The four (4) further years of access provided at no charge following the Paid Term. |
| Subscription Term | The Paid Term together with the Complimentary Extension, totalling five (5) years. |
| Hosted Services | Server-based features operated by Cyber AI Connect, including Dynamic Print, Photo Booth, Pending Files, Feature Requests, and Registration processing. |
| User | Any person who accesses or uses the Software on an authorised Device. |
| Fees | The amounts payable for a Licence as set out on the Cyber AI Connect website or in a written Order Form. |
| Intellectual Property | All copyright, trade marks, patents, design rights, trade secrets, source code, algorithms, and know-how embodied in the Software. |
| Consumer Law | The Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth). |
2.1 By using the Software, you confirm that you have read, understood, and agreed to these Terms on behalf of yourself and, where applicable, your organisation.
2.2 If you are entering into this Agreement on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity.
2.3 Cyber AI Connect reserves the right to amend these Terms at any time. Updated Terms will be published on the Cyber AI Connect website. Continued use of the Software after publication constitutes acceptance of those amendments.
2.4 If you do not agree to any amendment, your sole remedy is to cease using the Software and notify Cyber AI Connect in writing.
3.1 Subject to payment of all Fees and compliance with these Terms, Cyber AI Connect grants you a limited, non-exclusive, non-transferable licence (revocable only in accordance with clause 14) to install and use the Software solely:
3.2 Where you have purchased a single-Device Licence, installation on more than one Device constitutes a material breach.
3.3 Each Licence covers one Apeos Device, identified by serial number and product code. A Single App Licence is locked to the application chosen at purchase and cannot be switched to a different application. An All Apps Licence includes applications released during the Subscription Term at no additional charge.
3.4 Where you have purchased a 10-Device Site Bundle, the Software may be installed on up to ten (10) Devices at a single physical site belonging to a single customer entity. The bundle unlocks a single chosen application across those Devices; it may not be split across multiple sites or shared across different customers. Additional sites require separate licences.
3.5 A Licence may be transferred to a replacement Device (for example, following a warranty swap) without restarting the Subscription Term, on notice to Cyber AI Connect identifying the retired and replacement Devices.
3.6 The Licence does not include the right to sublicence, sell, transfer, assign, or use the Software as a service bureau or time-sharing facility.
4.1 All Licences are sold on a subscription basis. The Paid Term is twelve (12) months. The Subscription Term is sixty (60) months (5 years) and is measured from the date of first Device activation — not from the date of purchase or delivery.
4.2 As a promotional offer, Cyber AI Connect provides a Complimentary Extension of four (4) further years at no additional charge immediately following the Paid Term, giving a total Subscription Term of five (5) years. This promotional framing describes how the offer is marketed and does not limit any refund payable under clause 4.6 or under the Consumer Law.
4.3 Expiry and hard stop. At the end of the Subscription Term the licensed applications will stop functioning. This is a fundamental term of the Agreement and is disclosed prominently on the pricing page prior to purchase. Continued use after expiry requires the purchase of a new Licence.
4.4 Expiry notices. Cyber AI Connect will send expiry reminders at approximately ninety (90), thirty (30) and seven (7) days before the end of the Subscription Term, by email and on the Device screen. Renewal is not automatic. Failure to receive, or a delay in receiving, any notice does not extend the Subscription Term.
4.5 The Complimentary Extension is a discretionary benefit. It may be withdrawn or varied for new purchases at any time but will not be withdrawn from customers who have already commenced their Paid Term prior to any such withdrawal.
4.6 Where a refund is payable under these Terms or under the Consumer Law, it is calculated pro-rata by reference to the unexpired portion of the Subscription Term.
4.7 Fees are quoted in Australian dollars. GST applies to supplies made in Australia. Taxes applicable in other jurisdictions will be identified at the time of purchase.
4.8 On expiry of the Subscription Term, continued use requires the purchase of a new Licence.
5.1 You must not, and must not permit any User or third party to:
5.2 The Software is designed for use with Fujifilm Apeos multifunction devices only. Use on other devices is unsupported and at your sole risk.
6.1 All Intellectual Property in the Software remains the sole and exclusive property of Cyber AI Connect. Nothing in this Agreement transfers any Intellectual Property rights to you.
6.2 If you provide Feedback, you grant Cyber AI Connect a perpetual, irrevocable, royalty-free licence to use and commercialise that Feedback without obligation or compensation.
7.1 Each party agrees to keep confidential all Confidential Information of the other party. The Software, its architecture, features, and implementation methodology constitutes Confidential Information of Cyber AI Connect.
7.2 These obligations do not apply to information that is public knowledge, was independently developed, or is required to be disclosed by law.
8.1 The Software may integrate with third-party services including Microsoft OneDrive, Microsoft SharePoint, Microsoft 365, xAI Grok, text-to-speech providers, and Fujifilm Apeos APIs. Your use of those services is governed by the relevant third-party terms. Cyber AI Connect is not a party to any agreement between you and a Third-Party Service provider.
8.2 Third-Party Service providers may change or discontinue their services at any time. Cyber AI Connect accepts no liability for any resulting disruption to Software functionality.
8.3 Cyber AI Connect does not warrant, endorse, or accept any liability for Third-Party Services, their availability, accuracy, security, or the outputs they produce. The functionality, content, and responses generated by any Third-Party Service or API are entirely outside Cyber AI Connect's control. Cyber AI Connect is not responsible for any loss or damage arising from your use of or reliance on any Third-Party Service output.
9.1 Certain Software features operate through servers hosted and operated by Cyber AI Connect. These Hosted Services currently include:
9.2 Temporary files from Dynamic Print and Photo Booth are automatically deleted upon successful delivery. In the event of a processing failure, Cyber AI Connect will use reasonable endeavours to delete files within twenty-four (24) hours.
9.3 Cyber AI Connect does not access, read, or use the content of documents or images processed through Dynamic Print or Photo Booth for any purpose other than performing the requested processing and delivering the output to your Device.
9.4 Cyber AI Connect uses reasonable technical and organisational measures to protect data stored on its servers but does not guarantee uninterrupted or error-free server-based processing.
9.5 Cyber AI Connect reserves the right to modify, suspend, or discontinue any Hosted Service feature at any time without liability.
9.6 You are responsible for ensuring that any content, images, data, instructions, prompts, or directives you or your Users submit to the Hosted Services ('Submitted Content'):
9.7 — Third-Party API Output
9.7.1 Certain Hosted Services pass Submitted Content to Third-Party APIs to produce output, including AI-based image compositing, document translation, and text-to-speech conversion provided by third parties such as xAI (Grok), text-to-speech service providers, and Microsoft ('API Output'). Cyber AI Connect acts solely as a conduit in transmitting Submitted Content to these APIs and returning the resulting API Output. Cyber AI Connect does not review, verify, endorse, or exercise any editorial control over API Output.
9.7.2 Cyber AI Connect makes no representation or warranty as to the accuracy, completeness, reliability, legality, fitness for purpose, or suitability of any API Output. This includes but is not limited to: the accuracy or faithfulness of translated text; the quality, appropriateness, or legality of AI-generated images or composites; the accuracy of text-to-speech audio; or the compliance of API Output with any applicable law or third-party right.
9.7.3 You are solely responsible for reviewing and verifying all API Output before using, printing, distributing, publishing, or relying upon it for any purpose. You assume all risk associated with the use of API Output and acknowledge that Cyber AI Connect has no ability to predict, control, or guarantee the outputs of any Third-Party API.
9.7.4 CYBER AI CONNECT IS NOT LIABLE FOR ANY LOSS, DAMAGE, CLAIM, OR LIABILITY OF ANY KIND ARISING FROM OR IN CONNECTION WITH API OUTPUT, INCLUDING ANY CLAIM THAT API OUTPUT INFRINGES ANY INTELLECTUAL PROPERTY RIGHT, IS DEFAMATORY, IS INACCURATE, IS MISLEADING, OR VIOLATES ANY APPLICABLE LAW. YOUR SOLE RECOURSE IN RESPECT OF ANY API OUTPUT ISSUE LIES AGAINST THE RELEVANT THIRD-PARTY API PROVIDER.
9.8 You indemnify Cyber AI Connect against all claims, losses, damages, costs, and liabilities (including reasonable legal fees) arising from:
9.9 Cyber AI Connect's servers are located in Australia or with cloud infrastructure providers that may operate internationally. By using the Hosted Services, you consent to your data being processed on these servers in accordance with the Privacy Policy.
9A.1 Metered usage. Certain features consume metered usage — AI processing and SMS delivery — measured in dollars at Cyber AI Connect's published rates. Additional usage may be purchased at any time as prepaid credit.
9A.2 Included usage. Each Device includes five dollars ($5.00, inclusive of GST) of usage per calendar month, applied to AI processing and SMS delivery, calculated at Cyber AI Connect's published rates in force at the time of use. The included amount is granted monthly, does not roll over, and any unused portion expires at the end of each month. Additional usage may be purchased at any time as prepaid credit.
9A.2.1 The included amount applies only to Licences covering applications that consume metered usage. Applications that use neither AI processing nor SMS delivery consume no included usage and carry no included amount. The current list is published at cyberaiconnect.com/ai-data-handling.
9A.3 Published rates. Cyber AI Connect publishes the rates at which usage is charged. Rates may change to reflect changes in Cyber AI Connect's supply costs, including changes in the charges of AI and messaging providers and currency movements. Rate changes take effect on at least thirty (30) days' notice, apply only to usage occurring after the effective date, and do not affect prepaid credit already purchased, which is applied at the rate in force when it was purchased. Current rates are published at cyberaiconnect.com/rates.
9A.4 Fair use. An objective usage ceiling applies to each Device to protect the service against misuse and runaway consumption. The ceiling is the higher of fifty dollars ($50.00 inc GST) of usage per calendar month, or 150% of that Device's own established monthly usage, so that the ceiling rises with your normal usage rather than restricting it. The method and current figures are published at cyberaiconnect.com/rates.
9A.4.1 Rate of consumption. A short-interval consumption limit also applies, to detect runaway or automated consumption. The current limits are published at cyberaiconnect.com/rates.
9A.4.2 Where a limit is reached, Cyber AI Connect will notify you and may pause the affected features. Where the usage is legitimate, the limit will be raised on request — these limits exist to detect misuse and error, not to cap usage you have paid for.
9A.5 No guarantee of AI output accuracy. AI outputs are machine-generated and may be incorrect, incomplete, or unsuitable for your purpose. You are responsible for reviewing all AI output before relying on it. This is particularly important for the Language Translator and Scan to Audio applications, where errors in translation or speech synthesis may not be obvious.
9A.6 SMS delivery. Where SMS delivery is used, each message is charged against the included usage or prepaid credit at the published rate. Daily message limits apply per Device to protect against misuse; current limits are published at cyberaiconnect.com/rates. You are responsible for ensuring you have the recipient's consent to receive messages and for complying with the Spam Act 2003 (Cth).
9B.1 The Device self-registers on first use, and Cyber AI Connect issues a Device credential which is stored on the Device.
9B.2 You are responsible for the physical security of the Device and for controlling access to it.
9B.3 Cyber AI Connect may quarantine or suspend a Device where a credential conflict, or suspected unauthorised access, is detected. Where practicable, notice will be given, and the Device will be reinstated once the issue is resolved.
9B.4 Device identifiers — including serial number, product code, model, firmware version, MAC address, hostname, and LAN and WAN IP addresses — are collected as described in the Privacy Policy.
9C.1 Your chosen support partner may, with your authorisation, view and modify your Device settings and configuration. This may include stored SMB and Microsoft 365 credentials that you have entered into the Device.
9C.2 You choose your support partner, and you may change it. Changing partners is subject to the incoming partner's acceptance and to Cyber AI Connect's approval.
9C.3 Cyber AI Connect will notify you before any transfer of your support relationship takes effect. On transfer, the outgoing partner's access to your account and Device configuration is revoked.
9C.4 By authorising a support partner, you consent to the disclosure of the account and configuration information described in clause 9C.1 to that partner for the purpose of supporting your Devices. This consent is recorded and may be withdrawn, subject to your continued need for support.
9D.1 Licences are prepaid. The refund position is set out in clauses 4.6, 4.7 and 11. Where a cooling-off right applies by law, it is preserved.
9D.2 Where a payment is reversed or charged back, Cyber AI Connect will give notice and a reasonable period to cure before suspending the affected Licence.
9D.3 A payment dispute between Cyber AI Connect and a reseller or partner will not, of itself, cause an end customer's working Device to be suspended. An end customer's continued use is governed by that customer's own Licence status.
9D.4 Record retention. Financial records are retained for seven (7) years as required by section 286 of the Corporations Act 2001 (Cth). This retention obligation overrides deletion requests in respect of financial records; where you request erasure, personal contact information is anonymised while the underlying transaction record is retained, so far as the law permits. See the Privacy Policy for further detail.
9E.1 You may supply your own AI provider API credentials. Where you do, all AI processing for your Devices is performed using your credentials, and your agreement with that provider governs the charges you incur. Cyber AI Connect is not a party to that agreement and is not liable for those charges.
9E.2 Where you supply your own credentials, no included usage applies to AI processing. Cyber AI Connect charges a processing fee of 3.5% (customer-supplied) or 2.5% (partner-supplied) of the AI charges recorded through your credentials. The usage the fee is calculated from is available to you in your account.
9E.3 Cyber AI Connect continues to record usage and to apply usage limits and suspension rules to protect against misuse, whether or not it pays the underlying charges.
9E.4 You are responsible for the security of credentials you supply and may revoke them at any time. Revoking or invalidating credentials will disable the affected features.
10.1 Cyber AI Connect warrants that it has the right to grant the Licence, and that the Software will perform materially in accordance with the documentation for ninety (90) days from purchase ('Warranty Period').
10.2 If a breach of warranty is notified within the Warranty Period, Cyber AI Connect's sole obligation is, at its election, to repair or replace the Software or refund the pro-rata value of the unexpired portion of the Subscription Term.
10.3 TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE AND HOSTED SERVICES ARE PROVIDED 'AS IS'. CYBER AI CONNECT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND RELIABILITY.
11.1 Nothing in these Terms excludes, restricts, or modifies any right or remedy under the Consumer Law that cannot lawfully be excluded or limited.
11.2 To the extent the Consumer Law applies, Cyber AI Connect's liability is limited to resupplying the Software or services, or paying the cost of resupply.
11.3 Many supplies under these Terms are supplies to a 'consumer' as defined in the Consumer Law, including supplies to businesses, because the price is below the monetary threshold set by that law. Where the consumer guarantees apply, they apply in full, and nothing in these Terms operates to exclude, restrict or modify them.
12.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBER AI CONNECT'S TOTAL CUMULATIVE LIABILITY UNDER OR IN CONNECTION WITH THIS AGREEMENT SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU IN RESPECT OF THE AFFECTED LICENCE.
12.2 IN NO EVENT SHALL CYBER AI CONNECT BE LIABLE FOR ANY LOSS OF REVENUE, PROFIT, DATA, BUSINESS, OPPORTUNITY, OR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE LOSS OR DAMAGE.
12.3 Without limiting clause 12.2, Cyber AI Connect is not liable for loss arising from: (a) server downtime or interruption to the Hosted Services; (b) loss or corruption of data stored on our servers; (c) failure of automated file deletion processes; (d) third-party security events outside our reasonable control; or (e) any API Output generated by a Third-Party API, including any inaccuracy, illegality, or infringement contained in such output.
You agree to indemnify Cyber AI Connect against claims, losses, and costs to the extent arising from: your breach of these Terms; your unlawful use of the Software; or Submitted Content you provided — including any instructions or prompts that cause a Third-Party API to generate infringing, defamatory, or unlawful output, and any claim by an individual whose personal information or image you submitted without proper consent. This indemnity does not extend to loss caused by Cyber AI Connect's own act, omission, or breach.
14.1 Either party may terminate immediately on written notice for material breach (unremedied within 14 days if capable of remedy).
14.2 Cyber AI Connect may terminate or suspend immediately and without notice for breach of clause 5, clauses 9.6 or 9.8, insolvency, or as required by law. For non-payment, Cyber AI Connect will give at least seven (7) days' written notice and an opportunity to pay before terminating or suspending on that ground.
14.3 Suspension. Grounds for suspension include those in clauses 9A.4, 9B.3, 9D.2, this clause 14, and non-payment. Except where immediate action is required to protect the service or comply with law, Cyber AI Connect will give notice before suspending.
14.4 Data on termination. On termination or expiry: all Licences and Hosted Service access cease; you must destroy all copies of the Software. Your settings, address books and any stored credentials held on the Hosted Services will be deleted within thirty (30) days. Before that deletion, you will have a data retrieval window of at least fourteen (14) days from termination or expiry during which you may request an export of your configuration and address book data, subject to clause 9D.4 (financial record retention).
14.5 Accrued payment obligations survive termination.
14.6 Any refund on termination is calculated pro-rata by reference to the unexpired portion of the Subscription Term, in accordance with clause 4.6.
15.1 These Terms are governed by the laws of Queensland, Australia. Each party submits to the exclusive jurisdiction of the courts of Queensland.
15.2 The parties agree to attempt good-faith negotiation for 21 days before commencing legal proceedings, and to submit to mediation before litigation if negotiation fails.
16.1 Entire Agreement. These Terms constitute the entire agreement between the parties and supersede all prior representations and agreements.
16.2 Severability. If any provision is held invalid or unenforceable, the remainder continues in full force.
16.3 Waiver. No failure to exercise a right constitutes a waiver. All waivers must be in writing.
16.4 Assignment. You may not assign your rights without prior written consent. Cyber AI Connect may assign in connection with a merger or sale of assets.
16.5 Force Majeure. Cyber AI Connect is not liable for failure or delay caused by circumstances beyond its reasonable control.
16.6 Relationship. The parties are independent contractors. No partnership, agency, or employment relationship is created.
This Privacy Policy describes how we collect, hold, use, and disclose personal information in connection with the Apeos Device Info software, the cyberaiconnect.com website, and any related registration or support services (collectively, 'our Services').
When you register your interest, submit a support enquiry, or submit or vote on a feature request, we may collect:
When you visit our website we may collect IP address, approximate location, browser type, pages visited, and referring URL. We do not use advertising cookies.
Certain Software features transmit data to Cyber AI Connect's servers for processing:
We do not access, read, analyse, or use the content of documents or images processed through Dynamic Print or Photo Booth for any purpose other than performing the requested processing and delivering the output to your Device.
2.4.1 What is sent to xAI. Depending on the AI-powered application you use, scanned document images and extracted text are transmitted to xAI to perform optical character recognition (OCR), translation, speech synthesis, or image generation:
2.4.2 What is not retained. Documents processed by AI features are not stored by Cyber AI Connect after processing. Our usage metering records the cost of usage only — never document content.
2.4.3 Applications that do not use AI or SMS. Several applications — including Send Fax, Pull Print, Printer Meters and Scanner Capabilities — involve no AI processing and send no messages, transmitting no content to xAI or SMTP2GO. AI features may also be disabled at account level; see our AI Data Handling page.
2.4.4 What is sent to SMTP2GO. Where a feature sends an email or SMS on your instruction, the recipient's email address or phone number and the message content are transmitted to SMTP2GO solely to deliver the message. You are responsible for having the recipient's consent to be contacted.
2.4.5 Customer-supplied AI credentials. Where you supply your own AI provider credentials, AI processing for your Devices is performed through your own account with that provider under your agreement with them; see clause 9E of the Terms of Service.
To license, support and secure the Software, we collect Device and network identifiers, including: Device serial number, product code, model, firmware version, MAC address, hostname, LAN and WAN IP addresses, and browser user agent. We use this information for licensing, technical support, security monitoring and fraud prevention.
We maintain access logs, security logs, transaction logs and error logs. These are used to operate and secure the Services, investigate incidents, meet financial record obligations, and diagnose faults. Retention periods are set out in clause 9.
If you authorise a support partner, that partner may access your account and Device configuration — including settings and stored credentials — to provide support. You choose and may change your support partner, and the outgoing partner's access is revoked on transfer. See clause 9C of the Terms of Service.
We collect personal information through the Register Interest form, the Submit Feature Request form, email correspondence, telephone calls, and where permitted, from publicly available sources for business contact purposes. We collect only by lawful and fair means.
5.1 We will only send direct marketing communications with your express consent, or to existing customers regarding similar products where you have not opted out.
5.2 Every marketing communication includes a functional unsubscribe mechanism. We will action unsubscribe requests within five (5) business days in accordance with the Spam Act 2003 (Cth).
5.3 We will not send marketing communications to email addresses collected solely for the feature request voting function.
We may disclose personal information to: hosting and cloud infrastructure providers; email service providers; professional advisers; and government or law enforcement authorities where required by law. We do not sell, rent, or trade personal information to any third party.
7.1 xAI (AI processing). When you use an AI-powered feature, document content is disclosed to xAI for processing. xAI processes data on servers outside Australia, including in the United States. This disclosure is described in clause 2.4 and occurs only when you use an AI-powered feature.
7.2 SMTP2GO (email and SMS delivery). When a feature sends an email or SMS, recipient contact details are disclosed to SMTP2GO to deliver the message. SMTP2GO may process data on servers outside Australia, including in the United States. This disclosure is described in clause 2.4 and occurs only when a message is sent.
7.3 Other third-party services we use (such as hosting and cloud infrastructure providers) may also process data on servers outside Australia. We take reasonable steps to ensure overseas recipients handle information consistently with the Australian Privacy Principles.
7.4 By using our AI-powered or messaging Services, you acknowledge that the information described in clause 2.4 will be transferred to and stored outside Australia for the purpose of providing those features.
We take reasonable measures to protect personal information, including:
Despite these measures, no storage system is 100% secure. If we become aware of a data breach likely to cause serious harm, we will notify affected individuals and the OAIC as required under the Notifiable Data Breaches scheme.

You have the right to request access to personal information we hold about you, and to request correction of inaccurate or incomplete information. Contact us using the details in clause 14. We will respond within thirty (30) days at no charge.
On request we will erase personal information we hold about you. Where we are required by law to retain a record — for example invoices and financial records, which we must keep for seven (7) years under section 286 of the Corporations Act 2001 (Cth) — we will retain the record but remove or anonymise the personal information within it so far as the law permits. This means a deletion request does not erase the underlying financial transaction record, but the personal contact details associated with it will be anonymised.
